This disclaimer aims to outline our mutual understanding regarding backend interventions, limitations of liability, and the responsibilities of both parties. 1. Scope of Services The Marketing Hub will make every reasonable effort to ensure effective performance, functionality, and security of the website backend, including addressing issues or concerns as they arise. The scope of these services does not cover unrelated issues, integrations outside our remit, or any third-party hosting, plugin, or software service. 2. Client Responsibilities The Client agrees to: Provide Full Access: Supply all required login credentials and permissions for access to the website’s backend. Backup: Maintain up-to-date backups of the website and its data to prevent loss during troubleshooting or updates. Payment: Ensure payment of all fees and charges associated with backend support in a timely manner. 3. Limitations of Liability While The Marketing Hub commits to maintaining a high standard of care, the Client agrees to the following limitations: Data Loss and Website Downtime: We shall not be liable for any accidental data loss, corruption, or website downtime arising from backend troubleshooting, updates, or modifications. Third-Party Products and Services: We are not liable for any third-party issues, such as plugin or hosting incompatibilities or failures that may impact website performance. Security and Malware: While we implement best practices to enhance security, The Marketing Hub is not liable for breaches, malware, or unauthorised access stemming from factors outside our control, including outdated software or third-party integrations. 4. Service Modifications Any additional requests outside the initial scope of backend support will require a written agreement, including estimated costs and timeframes for completion. 5. Termination Either party may terminate this service agreement with 14 days' written notice. All outstanding fees shall be settled prior to termination. 6. Indemnification The Client agrees to indemnify and hold The Marketing Hub harmless from any claims, damages, losses, or costs arising from third-party claims or any direct or indirect consequences resulting from backend issues.
